This page explains how we gather and use information from people who access www.villagehouse.com, any of its subdomains, and any other websites maintained by Frost/Chaddock Developers, LLC, or FCE Wilton, LLC that link to this page (collectively, our “website”). You should read these policies carefully, bearing in mind that in exchange for allowing you to access our website, we require that you represent to us that you have read and understood the policies on this page and that you consent to them. We permit access to our website in reliance on such representation and consent by you. So if you haven’t read or do not consent to these policies, you may not use our website.

Please also bear in mind that from time to time we may modify our privacy policies in response to changes in law or changes in the information we gather or what we do with it. If we do make any modifications, we’ll post the modified policies here and change the date above to the date the new policies were first posted. We employ RENTCafé, an Internet platform owned and operated by Yardi Systems, Inc., to host the websites of our various apartment communities. Through RENTCafé, prospective tenants can apply for apartments and send us e-mail, and current tenants can request maintenance and arrange for electronic payments. In sum, RENTCafé allows prospects, tenants, and managers of our various apartment communities to communicate electronically. These privacy policies govern our use of personal information that we receive in only two ways: either directly from you via e-mail initiated from this website, or indirectly from you through RENTCafé. These policies do not govern how RENTCafé gathers or uses your personal information. We encourage you to read and become familiar with RENTCafé’s privacy policies, which may be found here. We are not responsible for RENTCafé’s privacy practices.

Our website is not intended for children and we do not knowingly solicit or collect personal information from children. If we learn that a child has submitted personally identifiable information to us through our website, we will take reasonable measures to delete such information from our records and to not use such information for any purpose, except as required by law.

Information that we collect directly includes any information you may provide in an e-mail to us initiated from our contact page. We generally do not retain such information, unless you become a tenant, in which case we maintain a personal tenant file with only material correspondence and other personally-identifying and relevant information gathered from you directly (through our website or other direct channels) or indirectly through RENTCafé. Personally identifiable information collected in this manner may include your name, e-mail address, postal address, zip codes, social security number, driver’s license number, prior addresses, monthly rent paid at prior residences, employers, job titles, income, telephone numbers, credit card information, bank account information and routing numbers, date of birth, sex, marital status, username, and password (if you choose to become a registered user of a community website), emergency contact information, pet or assistive animal information, vehicle information, and other information that helps us manage the applicable apartment community.

We do not directly gather any technical information from you, other than your e-mail address (if you provide it). So we don’t collect information typically collected by other commercial websites, like your Internet Protocol address, browser type, domain name, Internet service provider, referring page, date or time stamp, operating system, and so on, though we may store so-called “cookies” on your computer (text files placed on your computer that are used to store personal information). RENTCafé may collect such data, but it does not share them with us and we don’t ask them to.

Except as set forth below or as you specifically authorize, we will not voluntarily disclose any information we gather directly from you or information we gather indirectly from you via RENTCafé. We may disclose personal information:

  • to a person who in our reasonable judgment is seeking the information as an agent of the individual;
  • in situations where sharing or disclosing your information is required to offer you products or services you desire;
  • to a third party where disclosure is required or permitted by law, a judicial proceeding, a criminal investigation, a court order, or legal process; if, in our reasonable judgment, it is necessary to enforce compliance with our internal policies or our terms of use to prevent illegal activity or suspected fraud, or to protect our website, or others; and
  • to any other entity that acquires our organization by merger, reorganization, operation of law, or a sale of some or all of our assets.
  • We may be required to use or disclose your information in connection with a legal action or other proceedings, including in response to a court order or a subpoena. We may also disclose such information in response to a law enforcement agency’s request.

We maintain commercially reasonable safeguards to maintain the security and privacy of personal information that you provide to us. In spite of these protections, we cannot guarantee the security of any data submitted over the Internet. After your information reaches us, however, it is stored on servers (or in the case of information received from you in person, in writing or over the phone, in physical storage areas) protected by procedures and technology designed to block reasonably foreseeable intrusions by unauthorized third parties.

We retain your personal information for a reasonable period. We remove information from time to time when it appears we will no longer have a need to contact you; however, if you are not a current tenant or if you moved out at least three years ago, we will promptly remove your information (other than basic information about your tenancy: name, term, rent charges, and payment history) upon your written request. Paper files containing personal information are destroyed by shredding, and we destroy electronic information by deleting it. Though we employ commercially-reasonable safeguards to maintain the security and privacy of your personal information, we cannot guarantee the security of any data submitted over the Internet.
